In British Columbia, all tenancies, including those in basement suites, are governed by the Residential Tenancy Act (RTA). This law outlines the rights and responsibilities of both tenants and landlords. Your most important right is 'quiet enjoyment,' which means you have the right to live in your home without unreasonable disturbances.

Your landlord must provide a written tenancy agreement, and they cannot enter your suite without proper notice, which is typically 24 hours in writing, unless there is an emergency. A security deposit cannot be more than half of one month's rent. At the end of your tenancy, your landlord has 15 days to either return your deposit or file for dispute resolution to keep it.

Rent can only be increased once every 12 months, and the landlord must give you three full months' notice using the correct government form. The maximum allowable rent increase for 2026 is set by the provincial government. If you have a dispute with your landlord that you can't resolve, you can apply for dispute resolution through the Residential Tenancy Branch.
