03The Process

Buying a presale means purchasing a home before it is built, based on plans and a contract with the developer. In British Columbia, this process is highly regulated. After you sign a contract, you have a legally mandated seven-day rescission period, during which you can cancel the agreement for any reason and have your deposit fully refunded.

Deposits for presales are typically between 10% and 20% of the purchase price, but they are usually paid in installments over several months or longer. By law, these funds must be held in a trust account, protecting your money in case the project does not proceed. Before you sign, the developer must provide a Disclosure Statement, a comprehensive document outlining all material facts about the development.

An assignment is when the original buyer sells their contract to a new buyer before the building is completed. This is only possible if the developer allows it in the original purchase contract. Completion dates are the developer's best estimate and can be subject to delays from labour or supply chain issues; the contract will outline the terms for any such extensions.

04The Taxes

In British Columbia, new construction homes are subject to a 5% Goods and Services Tax (GST) on the purchase price. This tax does not apply to the purchase of used residential homes. The GST is payable at the time of completion when the title of the property is transferred to you.

The federal government offers a GST New Housing Rebate for new homes intended as a principal residence. A partial rebate is available for homes priced up to $450,000. However, a separate, more substantial First-Time Home Buyers' GST Rebate was introduced, offering a full rebate on homes up to $1 million and a partial rebate for homes valued between $1 million and $1.5 million.

Buyers must also budget for the provincial Property Transfer Tax (PTT). However, a PTT exemption exists for newly built homes, which eliminates the tax for qualifying properties with a fair market value up to $1,100,000, with a partial exemption up to $1,150,000.

The 2-5-10 Home Warranty

Nearly every new home built in British Columbia by a licensed builder comes with mandatory third-party warranty insurance. This is commonly known as the "2-5-10 warranty," which refers to three distinct coverage periods for different aspects of your home. This warranty is attached to the home, not the owner, and transfers automatically to the next owner if you sell within the coverage period.

The '2' represents two years of coverage for defects in materials and labour. This includes things like flooring, fixtures, and trim. It also covers the delivery and distribution systems for electrical, plumbing, heating, and air conditioning for 24 months.

The '5' signifies five years of coverage for the building envelope, which includes protection against unintended water penetration. This is a critical protection in BC's climate. The '10' provides a decade of coverage for the major structural components of the home, such as the foundation and frame, protecting against defects that affect its structural integrity.
